Trump Asks High Court Approval for Military Reserve Personnel in the State of Illinois

On the end of the week, the administration filed an emergency request to the US supreme court, seeking approval to send state guard personnel to the state of Illinois.

This step is part of a wider push to expand the domestic use of the troops in multiple urban centers under Democratic control.

Court Fight Over Military Presence

In an immediate request, the US Department of Justice pressed the bench to reverse a lower court ruling that had stopped the deployment of several hundred national guard members to the greater Chicago.

The district judge had raised doubts about the administration's explanation for activating the guard, doubting its explanation in considering the situation on the ground.

A higher court upheld the previous order on Thursday, leaving the activation on hold while the judicial dispute moves forward.

Government's Arguments

The top government lawyer, representing the administration, wrote in the recent request that government officers have often been “menaced and assaulted” in downtown Chicago and the outlying area of Broadview.

This area is home to an ICE holding center.

The commander-in-chief has already sent military reserve personnel to the Windy City and the city of Portland, subsequent to earlier sendings to Los Angeles, Memphis, Tennessee, and Washington DC.

The White House has stated that troop deployment is necessary to control demonstrations and strengthen immigration enforcement.

Partisan Pushback

Elected Democrats have vehemently criticized the action, arguing that the president’s claims are inflated and politically motivated.

They allege the former president of abusing his authority to target political rivals.

The judiciary have also expressed doubt about the government's portrayal of ongoing incidents.

Local leaders claim that demonstrations over immigration enforcement have been mostly small and non-violent, challenging the administration's characterization of “combat area” situations.

Statutory Grounds

At the center of the dispute is the president’s use of a US code allowing the president to take control of the national guard only in cases of uprising or when “powerless with the federal troops to enforce the regulations of the United States”.

The White House maintains that the personnel are essential to safeguard federal property and officers from demonstrators.

Latest Actions

Earlier this month, the White House federalized several hundred troops of the state guard of Illinois and ordered more Texas-based forces into the region.

As state authorities denounced the action, the White House intensified his language, demanding the detention of Chicago’s mayor and the state's chief executive, each a Democrat, alleging them of not managing to safeguard federal agents.

The state of Illinois and municipal government filed a combined lawsuit the government to halt the deployment.

On the ninth of October, the presiding federal judge, a Biden appointee, handed down a temporary injunction stopping the command.

Simultaneously in the Chicago area, at least a dozen people were detained outside the Broadview Ice detention center following serious disputes between local police and activists.
